Ice Melt Contest Rules

1. Eligibility

Evergreen Ice Melt (the “Contest”) is open to all legal residents of the fifty (50) United States and the District of Columbia at the time of entry. Members of the Mountain Foothills Rotary Club of Evergreen and other companies associated with the Contest, their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such person are not eligible. The Contest is subject to federal, state, and local laws and regulations.

2. Contest Sponsor

The Contest is sponsored by the Mountain Foothills Rotary Foundation, PO Box 1918, Evergreen, CO 80437 ("Contest Sponsor").

3. Agreement of Official Rules

Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Contest Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Contest Period

The Contest begins on November 1, 2023, at 12:00 AM and all entries for the Contest must be received by midnight (Mountain Daylight Time) on March 17, 2024 or the date and time the barrel falls through the ice, whichever is earlier (the “Contest Period”). Entries that are submitted before or after the contest period will be disqualified. Submissions will be accepted for the duration of the Contest using any of the following methods:

Mail-In: PO Box 1918, Evergreen, CO 80437
In Person: Submitted to a Rotarian or Businesses Selling Tickets
Online: https://evergreenicemelt.com

5. How to Enter

Mail In: This method of entry will be available for the entire Contest Period. Official Contest ticket stubs having a full name, phone number, email address, the date and time to the minute and second of when the barrel will fall through the ice on Evergreen Lake in Evergreen, Colorado along with a high temperature of the day mailed to PO Box 1918, Evergreen Colorado, 80437 will be accepted. All entries must be received within the Contest Period outlied above in Section 4.

In Person: This method of entry will be available for the entire Contest Period. Official Contest ticket stubs having a full name, phone number, email address, the date and time to the minute and second of when the barrel will fall through the ice on Evergreen Lake in Evergreen, Colorado along with a high temperature of the day handed to a Mountain Foothills Rotarian or an authorized business selling tickets will be accepted. All entries must be received within the Contest Period outlied above in Section 4.

Online: This method of entry will be available for the entire Contest Period. Official Contest website submittals having a full name, phone number, email address, the date and time to the minute and second of when the barrel will fall through the ice on Evergreen Lake in Evergreen, Colorado along with a high temperature of the day submitted to https://evergreenicemelt.com will be accepted. All entries must be received within the Contest Period outlied above in Section 4.

6. Prize Drawing

On the date and time to the minute and second determined by the Contest Sponsor when the barrel falls through the ice on Evergreen Lake in Evergreen, Colorado (“Ice Melt Date”), the Contest Sponsor will select potential winners based upon the closest date and time to the Ice Melt Date. Daylight Savings and Standard Time will be accounted in determining the date and time based upon the devices tracking the date and time at the barrel. In the event of a tie, the high temperature of the day will be used as a tiebreaker. The odds of winning depend on the number of entries received and the closest time to Ice Melt Date determined by the Contest Sponsor. Due to the hazards of retrieving the barrel from the Lake, the Contest Sponsor will notify potential winners by telephone and/or email within thirty (30) days of the Ice Melt Date. If the potential winners cannot be contacted or do not respond with five (5) days of the first contact attempt, the Contest Sponsor may select alternate winners in their place based upon the next closest date and time to the Ice Melt Date.

7. Prizes

Closest Time: $1,000.00
Second Closest Time: $500.00
Third Closest Time: $250.00
Fourth Closest Time: $125.00

8. General Conditions

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human intervention or technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by the Contest Sponsor in its sole discretion, the Contest Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conform to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prizes at random from among the eligible, non-suspect entries received up to the time of impairment. The Contest Sponsor reserves the right to in its sole discretion to disqualify any entry or individual tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Contest Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from such person to the fullest extent permitted by law. Failure by the Contest Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

9. Release of Liability

By participating in the Contest, entrant agree to release and hold harmless the Contest Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other entities associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest of receipt or use of the prizes (including travel or activities related thereto), including but not limited to: (a) any technical errors associated with the Contest including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typological errors; (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, postage-due or misdirected mail, entries, application downloads; (e) any other errors or problems in the connection with the Contest, the announcement of winners, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect submittal of ticket stubs, the processing of ticket stubs or in any Contest related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participating in the Contest or acceptance, receipt or misuse of prizes (including travel or activity related thereto). Entrants further agree that any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrants be entitled to receive attorney’s fees. Released Parties are also not responsible for an incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

10. Disputes

Except where prohibited, each entrant agrees that and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in Colorado. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Colorado, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Colorado.

11. Privacy

Information collected from the entrants is subject to the Contest Sponsor’s privacy policy.

12. Winner List

To request the list of winners, send a self-addressed envelope to PO Box 1918, Evergreen, Colorado 80437. Lists of winners request will only be accepted after the Contest end date as been determined by the Contest Sponsor (listed above).
